These Terms of Service (“Terms”) govern your access to and use of The Testimonial Collective website and services. “The Testimonial Collective,” “Company,” “we,” “us,” or “our” refers to The Testimonial Collective, the service provider offering the services described herein. By accessing this website, purchasing services, or completing checkout, you agree to be bound by these Terms.
If you do not agree, please do not use this website or our services.
Services
The Company provides done-for-you testimonial video production services. Services may include, but are not limited to, client outreach, interview coordination, remote recording, editing, and delivery of video assets, as outlined in the selected package or written agreement.
All services, deliverables, timelines, and revision limits are defined at the time of purchase.
Project Start Date and Timeline
The project start date is defined as the date on which the kickoff strategy call has been completed, provided that full payment has been received.
Standard delivery timelines are approximately six (6) weeks from the project start date. Due to the nature of third-party participation and scheduling, the Company will continue reasonable, documented, good-faith efforts to complete services for up to ten (10) weeks from the project start date.
Delivery timelines may be impacted by participant availability, participant non-participation, rescheduling, or other factors outside the Company’s control. The Company is not responsible for missed deadlines resulting from such factors.
Payments and Chargebacks
All fees are due in full prior to the start of services unless otherwise agreed in writing.
Because the Company’s services involve custom creative work, coordination, and scheduling, payments are non-refundable once work has begun except as expressly stated in the Conditional Testimonial Delivery Guarantee and Refund Policy below.
Clients agree not to initiate chargebacks or payment disputes for services rendered in accordance with these Terms. In the event of a chargeback or dispute, the Company reserves the right to suspend services and submit documentation of work performed.
Revisions
Each package includes a defined revision window and number of revisions, as outlined at the time of purchase.
Revisions are limited to adjustments within the original scope of work and do not include:
re-recording interviews
adding new deliverables
changing previously approved creative direction
revisions requested after the revision window has closed
Requests outside the agreed scope may require additional fees.
Client Responsibilities
Clients agree to:
provide accurate and timely information about their business and services
complete required intake materials
participate in the kickoff strategy call
review and approve deliverables within the applicable revision window
Clients are not responsible for scheduling, coordinating, or ensuring attendance of testimonial participants. Participant outreach, scheduling, and coordination are handled entirely by the Company.
Delays caused by client non-responsiveness to required approvals, intake materials, or revision feedback may impact delivery timelines. The Company is not responsible for missed deadlines resulting from such delays.
If the client is unresponsive for fourteen (14) consecutive days regarding required approvals or feedback, the project may be paused. Restarting the project may require rescheduling availability and does not guarantee the original delivery timeline.
Participant Scheduling, Attendance, and No-Shows
The Company is responsible for testimonial participant outreach, scheduling, and coordination.
Participation is voluntary and dependent on third-party availability and consent. The Company cannot guarantee attendance, participation, or completion of interviews by any individual.
Participant cancellations, reschedules, refusals to participate, or no-shows may impact delivery timelines. The Company will make reasonable, documented, good-faith efforts to reschedule interviews and complete contracted deliverables within the timeframes outlined in these Terms.
The Company is not liable for delays or non-delivery caused by participant unavailability, refusal to participate, or withdrawal of consent.
Conditional Testimonial Delivery Guarantee
The Company guarantees that it will make reasonable, documented, good-faith efforts to secure, record, and deliver the number of testimonial videos contracted for, subject to these Terms.
Delivery of testimonial videos is contingent upon voluntary third-party participation, which is outside the Company’s control. The Company does not guarantee participation by any specific individual or the substance of any testimonial.
If, after ten (10) weeks from the project start date, the contracted number of testimonial videos cannot be recorded and delivered due to lack of participant agreement, the client shall be eligible for a full refund, provided the client has complied with all responsibilities under these Terms.
This refund shall serve as the client’s sole and exclusive remedy for non-delivery due to participant non-participation.
Refund Policy and Approval Finality
If a client is not reasonably satisfied with the delivered testimonial videos prior to final approval, the client must notify the Company in writing within the applicable revision window. The Company will make reasonable, good-faith efforts to address concerns within the agreed scope of revisions.
If, after good-faith revision efforts, the client remains dissatisfied before approving the final videos, the Company may, at its discretion, issue a refund. Any refund issued requires the client to immediately cease all use of the delivered video assets.
Once final approval is given, whether explicitly or implicitly through confirmation, publication, download, or use, all sales are final. No refunds will be issued after approval.
Under no circumstances may a client receive a refund and continue to use, publish, distribute, or benefit from delivered video assets. Any unauthorized use following a refund constitutes a material breach of these Terms.
Intellectual Property and Usage Rights
Upon full payment, clients receive the right to use the final delivered testimonial video assets for their business and marketing purposes.
To reflect the nature of our work and demonstrate the quality of our services, the Company may display completed testimonial videos on its website, portfolio, social channels, or other promotional materials, unless the client requests otherwise in writing prior to delivery.
Raw footage, source recordings, project files, and working files remain the property of the Company and are not included as part of standard deliverables. At the Company’s discretion, raw footage may be made available for an additional fee upon request.
Confidentiality
The Company agrees to keep confidential any non-public business information provided by the client and to use such information solely for the purpose of delivering services.
No Guarantee of Results
The Company does not guarantee specific outcomes, including sales, conversions, revenue, audience growth, or business performance.
Any use of the term “guaranteed” in marketing materials refers solely to the Conditional Testimonial Delivery Guarantee described in these Terms.
Legal Entity Disclosure
The Testimonial Collective is a trade name of Chapman Creative LLC, an Illinois limited liability company. All references to “The Testimonial Collective” or the “Company” in these Terms refer to Chapman Creative LLC.
Indemnification
Clients represent and warrant that they have all necessary rights and permissions to provide business information and participant details. Clients agree to indemnify and hold harmless the Company from any claims arising from client materials, participant disputes, or client representations.
Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages.
The Company’s total liability shall not exceed the amount paid for the services giving rise to the claim.
Termination
The Company reserves the right to refuse or terminate services if a client violates these Terms or engages in abusive, unethical, or unlawful behavior.
Governing Law and Venue
These Terms are governed by the laws of the State of Illinois. Any disputes shall be brought exclusively in the state or federal courts located within Illinois.
Assignment and Subcontracting
The Company may subcontract or assign portions of the services as necessary to fulfill its obligations.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
